Debian based distros use a combination of dynamic and static messages for the motd. /etc/update-motd.d contains a number of scripts which add a static header, dynamic content and a static footer (/etc/motd.tail). /etc/motd is a symbolic link to /var/run/motd which is constructed at each login. This has all been moved out of /etc/login.defs and moved to /etc/pam.d/login.
